If you are using Funnder on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Description of Services

Funnder provides AI-powered communication, scheduling, customer engagement, and automation solutions, including but not limited to:

• Lead capture and qualification
• Appointment booking and reminders
• Multi-channel messaging
• CRM and calendar integrations
• Dashboard analytics
• Automated workflows and routing

These services may evolve over time through updates, improvements, and new features.

3. User Responsibilities

You agree to:

• Provide accurate and complete information when registering or configuring services
• Use Funnder only for lawful purposes
• Maintain the confidentiality of your login credentials
• Comply with all applicable laws and regulations
• Ensure that any data you upload or connect (CRM, communication channels, etc.) is authorized and permitted

You may not:

• Misuse Funnder's platform
• Attempt to reverse-engineer or disrupt our systems
• Engage in fraudulent or harmful activity
• Use the service to send unlawful, abusive, or misleading communications

4. Customer Data

You retain ownership of all data you provide or connect to the platform.

By using the service, you grant Funnder a limited license to process, transmit, store, and analyze this data solely for the purpose of operating and improving the service.

Funnder does not claim ownership of your CRM records, contacts, messages, or business information.

5. Service Availability

We strive to maintain 24/7 availability; however, system downtime may occur for maintenance, upgrades, or unforeseen circumstances.

Funnder is not liable for any service interruption, data delay, or communication failure beyond our reasonable control.

6. Fees and Payments

If your plan requires payment:

• Fees must be paid on time according to your subscription
• Failure to pay may result in suspension or cancellation of service
• Prices are subject to change with prior notice
• All fees are non-refundable unless otherwise stated in writing

7. Integrations and Third-Party Services

Funnder integrates with third-party platforms such as CRM systems, communication tools, payment processors, calendar services, and analytics providers.

We are not responsible for:

• Third-party outages
• Data loss caused by external platforms
• API limitations or restrictions
• Changes to third-party functionality

Use of third-party services is governed by their respective terms and policies.

8. Prohibited Use

You may not use Funnder to:

• Collect data without consent
• Provide medical, legal, or financial advice beyond your qualifications
• Automate harmful or deceptive behavior
• Violate privacy laws such as HIPAA, GDPR, or CCPA

Failure to comply may result in immediate termination.

9. Limitation of Liability

Funnder is not liable for:

• Lost revenue
• Missed appointments
• Errors in customer data
• Communication delays
• Damages arising from misuse of the service
• Third-party system failures

Your sole remedy for dissatisfaction with the service is to discontinue use.

10. Termination

We may suspend or terminate your access if you:

• Violate these Terms
• Abuse or misuse platform features
• Fail to pay required fees

Upon termination, access to your data may be limited or removed according to our data retention practices.
